PART A: WEBSITE TERMS OF USE

1. Use of the Website

You agree to use this website for lawful purposes only and in a manner that does not infringe the rights of, or restrict the use of this website by, any third party.

2. Website Accuracy & Liability

While I ensure the information provided on this website is accurate and current, I make no warranties regarding its absolute completeness. I am not liable for any loss or damage you may suffer from utilizing this website. Your statutory rights under Australian Consumer Law remain unaffected.

3. Third-Party Links & Privacy

This website may contain links to external sites (such as published editorials). I am not responsible for the content, security, or privacy practices of these external sites. Any data submitted via this website is handled in accordance with my Privacy Policy.

4. Intellectual Property

All imagery, portfolio work, and content on this website are owned by Madeleine Goldsmith unless otherwise credited. You may not copy, reproduce, or distribute any content without prior written permission.

5. Changes to Terms

I may update these Terms at my discretion. Continued use of the website following any updates indicates your acceptance of the revised Terms.

PART B: COMMERCIAL SERVICE & BOOKING TERMS

6. Commercial Bookings & Timings

All commercial bookings are quoted on a case-by-case basis, with timings and locations tailored specifically to the scope of your project. For standard e-commerce and content bookings, I allocate 1 hour per talent for hair and makeup completion. My standard commercial rates cover services for up to 2 talent; additional talent may require an assistant fee, which will be quoted upon application (P.O.A.).

7. Overtime & Surcharges

Overtime is charged at a rate of $150 per hour. Bookings scheduled on public holidays will incur a 15% surcharge on the total service fee.

8. Travel & Accommodation

Travel is charged at $60 per hour, with no travel fee applied for locations within a 50km radius of the Melbourne CBD. For regional, interstate, or destination shoots requiring early call times, prior accommodation may be required and must be covered by production.

9. Cancellations

If a commercial cancellation occurs 24 to 48 hours before the scheduled shoot date, 50% of the total agreed fee is payable. If a cancellation occurs less than 24 hours before the shoot date, 100% of the total agreed fee is payable.

10. Health, Safety & Liability

I hold valid Public Liability and Kit Contents Insurance, alongside a valid Infection Control Training certificate. I reserve the right to refuse services to any talent presenting with a contagious illness or condition (such as conjunctivitis or cold sores) to protect the wider production. A COVID-19 Safety Management Plan is available to production upon request.

11. Confidentiality & Media Release

I strictly respect the confidentiality of all unreleased commercial projects, campaigns, and creative briefs, adhering to all production NDAs and embargoes. Once a project is publicly released, the client agrees that I may use the final published imagery, as well as behind-the-scenes content captured by me, on my portfolio and social media channels to showcase my work. Photographers, directors, and the wider creative team will always receive appropriate credit.

12. Governing Law

These Terms are governed by the laws of Victoria, Australia. Any disputes will be subject to the exclusive jurisdiction of the courts of Victoria.
